Your name, address, e-mail and telephone details, gender, marital status, family status, date of birth, educational background, physical attributes, activity records such as driving records, photos, employment history, skills, and experience, claims detail(s) and sensitive information.

• Financial Information and Account Information

Card number for payment purposes, bank account number and other financial details.

• Identification Information

Identification card number, birth certificate number of your child, passport number, employment pass or work permit number, employees' provident fund member number, tax identification number, military identification number, driver's or other licensed number.

• Communication and Recording

Communication in any form including via e-mails, SMS (short message service), WhatsApp or other messages, and recorded conversations between our representatives, call centers and you.

• Management of Products and Services

We maintain certain information such as property address, vehicle license plate, travel plans, policy and claims details, information obtained for the purpose of customer due diligence and other insurance policy that you have.

• Marketing, Campaigns, Promotions and Surveys

You may inform us of your marketing preference, participation in campaigns and product promotions or respond to a voluntary customer satisfaction survey. Some of these activities have additional terms and conditions, which may contain further information about how we use and disclose your personal data. • Social Media Information

Your social media account ID, profile picture and other personal data that you provide to us through AXA AFFIN digital platforms. If you prefer to connect your social media account provided by another social media service provider to your account(s) on any of AXA AFFIN digital platforms, personal data from your social media account will be shared with us, which may include personal data that is part of your social media account profile or your associates’ profiles.

• for generally protecting our rights and property as well as ensuring the technical competence and functioning of our systems;

• to assess any amount of liabilities to or from you and collecting or recovering any amount owing from you or any person who has provided security or as guarantor for such liabilities of yours;

• to allow an actual or proposed purchaser, assignee, transferee, participant, or sub-participant of AXA AFFIN or any of AXA AFFIN Affiliates’ rights or business to assess the transaction meant to be the subject of reorganization, merger, sale, joint venture, assignment transfer, participation, or sub-participation;

• for audit, compliance, analysis, and inspection purposes;

• for marketing (including direct marketing) of insurance products;

• to conduct market research, understand and analyze customer behavior, location, preferences, and demographics for us to offer you other products and services as well as carry out special offers and marketing programs which may be relevant to your preferences and profile;

• to exercise any rights AXA AFFIN or any of our Affiliates may have relating to the terms and conditions of insurance products and services to you; and

• any other purposes which are related to the aforesaid.

Transfer of Personal Data

Due to the global nature of AXA Group and business network worldwide, for the purposes set out above we may transfer personal data internationally to parties located in other countries that have a different data protection regime. The personal data may be transferred to AXA AFFIN data centers, our associates, related companies and affiliates (“AXA Group”), service providers, business partners, governmental or administrative authorities for us to fulfill the purposes which directly or indirectly corresponds to the purpose of collecting the personal data.

Disclosure of Personal Data

We may disclose your personal data for the abovementioned purposes to the following parties (including those within and outside Malaysia):

• our associates, related companies and affiliates (“AXA Group”);

• any intermediaries, service providers, contractors, sub-contractors or third parties who provide services to the companies within the AXA Group;

• any person who has a duty of confidentiality to us such as external auditors, medical practitioners, trustees, legal practitioners, consultants, insurance companies, reinsurers and actuaries;

• government agencies, statutory bodies, and other authorities;

• our business partners and strategic alliances;

• By connecting your AXA AFFIN digital platforms account and your other social media account you permit us to disclose data with the provider of your other social media account and you comprehend that the use of the data we disclose will be governed by the other service provider’s social media website’s privacy policy. If you do not wish your personal data to be disclosed with other users or with your other social media account provider, please do not link your other social media account with your AXA AFFIN digital platforms account and do not take part in social sharing on AXA AFFIN digital platforms;

• You may also disclose personal data on message boards, chat rooms, profile pages, and blogs, as well as other AXA AFFIN digital platforms where you can upload data and contents. Kindly be informed that any information you upload or disclose via these platforms will be viewed by site visitors, users of AXA AFFIN digital platforms as well as the community. We advise you to be cautious when attempting to disclose your personal data, or any other related information when utilizing AXA AFFIN digital platforms;

• our assignees or potential assignees, acquirers or potential acquirers and successors-in-title;

Access, Change and Delete Requests

We take all reasonable steps to ensure that the personal data provided by you, or your authorized party is accurate, complete, not misleading and kept up-to-date consistent with the purpose for which the personal data was collected and further processed.

Under applicable laws and regulations, you may have the right to:

• access to or amend or correct your personal data that is inaccurate, incomplete, misleading, or not up to date;

• request deletion of your personal data under certain grounds;

• withdraw your consent or request a change to your scope of consent;

Implementing adequate measure to protect your personal data is AXA AFFIN’s utmost priority to ensure it is aligned with relevant data privacy and financial services laws. Nonetheless, no data transmission over the internet or data storage system can be fully secured. If you have reason to believe that your interaction with us is compromised, please notify us immediately.

Retention

We will not retain your personal data longer than is necessary for the fulfilment of the original purpose for which it was collected. We will take all reasonable steps to ensure that your personal data is destroyed or permanently deleted if no longer required unless such retention is necessary for our operational, audit, legal, regulatory, tax or accounting purposes.


Other Individuals Personal Data

When providing other individuals personal data to us, you undertake:

i) to notify the individual of this Notice; and

ii) to acquire any legal consent for the collection, use, disclosure, and transfer (including international transfer) of personal data relating to the individual pursuant to this Notice.

Other Information Collected

“Other information” is any information that does not reveal your individual identity, such as Web Browser and electronic device information, App usage data, information collected through cookies, pixel tags and other automations, demographic information and other information provided by you and associated information.

We and our service providers may collect additional information in various ways, including:

• App usage data when you download and use the Apps, such as the date and time your electronic device access our servers and what information and files have been downloaded to the Apps based on your device number.

• Cookies are data files that are saved directly on the computer you are using. Cookies enable us to identify your computer and gather information such as your internet browser type, time spent using the AXA AFFIN digital platforms, pages visited, language preferences, and applicable country sites. We may use the information for security purposes, improve navigation, display information more effectively,  tailor your experience while using the AXA AFFIN digital platforms, or collect statistical data about AXA AFFIN digital platforms usage. Cookies also allow us to present you with advertising or offers that are likely to be of interest to you. • Certain information such as your location or preferred means of communication is collected when you willingly share it with us. Unless combined with personal data, this information does not personally describe you.

Kindly be advised that we may use and disclose Other Information for any purpose, except where we are required to do otherwise under the relevant law. Kindly be informed that AXA AFFIN is not liable for the collection, use, processing and sharing of policies and acts of other organizations, app developer, app provider, social media platform provider, operating system provider, wireless service provider or electronic device manufacturer which contains any personal data you share.

·       Maklumat Pengenalan

Nombor kad pengenalan, nombor sijil kelahiran anak, nombor passport, pass pekerjaan atau permit pekerjaan, nombor kumpulan wang simpanan pekerja, nombor pengenalan cukai, nombor pengenalan tentera, lessen memandu atau nombor lesen yang berkaitan.

·       Komunikasi dan Rekod

Komunikasi melalui e-mel, SMS (perkhidmatan pesanan ringkas), WhatsApp atau mesej lain dan perbualan yang dirakam antara anda, wakil serta pusat panggilan kami.

·       Pengurusan Produk dan Servis

Kami mengumpul data seperti alamat hartanah, plat kenderaan, perancangan perjalanan,maklumat mengenai polisi dan tuntutan insurans, maklumat yang diperoleh bagi tujuan usaha wajar pelangan serta polisi insurans lain kepunyaan anda.

·       Kempen Promosi, Pemasaran dan Maklum Balas Pelanggan

Anda boleh memaklumkan kepada kami mengenai seleksi pemasaran, penyertaan serta promosi produk atau memberi maklum balas pelanggan. Sesetengah aktiviti ini mempunyai terma dan syarat tambahan yang mungkin mengandungi maklumat tambahan tentang cara kami mengguna dan menzahirkan Data Peribadi anda. ·       Untuk pelaksanaan perjanjian-perjanjian diantara AXA AFFIN dan anda;

·       Untuk pelaksanaan fungsi-fungsi kami;

·       Untuk menyediakan produk insuran dan perkhidmatanyang berkaitan dengan anda dan mentadbir, menyelenggara, mengurus dan mengendalikan produk dan/atau perkhidmatan tersebut termasuk apa-apa pembaharuan polisi insurans;

·       Untuk memproses, menilai dan memutuskan sebarang permohonan atau permintaan yang anda buat untuk produk danperkhidmatan insuran;

·       Untuk pelaksanaan proses usaha wajar bagi mengendalikan semakan latar belakang untuk mengesahkan maklumat yang disediakan oleh anda;

·       Untuk proses tuntutan atau penyediaan perkhidmatan berhubung dengan polisi insuran atau servis yang disediakan olehAXA AFFIN;

·       Untuk menilai kelayakan anda bagi plan pembayaran,pemprosesan premium dan pembayaran anda yang lain;

·       Untuk memperibadikan pengalaman anda  dengan memberikan maklumat dan iklan yang memenuhi keperluan anda di platform digital AXA AFFIN;

·       Untuk mengurus maklum balas, permintaan untuk mengakses,memadam atau membetulkan data;

·       Untuk mematuhi tuntutan undang-undang, kaedah,peraturan, garis panduan dan/atau keperluan undang-undang atau kawal atur yang terpakai, dan juga untuk keperluan kerajaan, agensi penguatkuasaan undang-undang,dan pihak berkuasa yang kami tertakluk kepada, atau apa-apa perintah Mahkamah;

·       Untuk tujuan litigasi, membela atau membalas sewajarnya kepada tindakan undang-undang sebenar atau berpotensi ataupertanyaan yang melibatkan badan berkuasa dan badan bukan berkuasa;

·       Secara umumnya untuk melindungi hak-hak dan aset kami dan juga untuk memastikan kecekapan teknikal dan fungsi sistem kami;

·       Untuk memantau dan mengesan apa-apa aktiviti penipuan dalam industri insurans;

·       Untuk menentukan apa-apa amaun liabiliti kepadaatau daripada anda dan menuntut amaun daripada anda atau mana-mana inividu yang telah memberikan jaminan atau akujanji bagi sebarang liabiliti anda.

·       Untuk membenarkan pembeli sebenar atau yang dicadangkan, penerima serah hak, penerima pindahan, peserta atau sub-pesertaAXA AFFIN atau mana-mana hak atau perniagaan syarikat sekutu AXA AFFIN menilaitransaksi yang dimaksudkan untuk menjadi subjek penyusunan semula,penggabungan, penjualan, usaha sama, pemindahan tugasan, penyertaan atau sub-penyertaan;

·       Untuk tujuan audit, pematuhan, analisis dan pemeriksaan;

·       Untuk pemasaran (termasuk pemasaran langsung)produk insurans;

·       Untuk menjalankan penyelidikan pasaran,memahami dan menganalisis tingkah laku pelanggan, lokasi, pilihan dan demografi untuk kami menawarkan produk dan perkhidmatan lain kepada anda serta menawarkanpromosi tawaran istimewa dan program pemasaran yang mungkin berkaitan denganpilihan dan profil anda;

·       Untuk melaksanakan apa-apa hak AXA AFFIN atau syarikat sekutu kami yang mungkin ada berkaitan dengan terma dan syarat produk danperkhidmatan insurans kepada anda; dan

·       apa-apa tujuan lain yang berkaitan dengantujuan yang dinyatakan di atas;

Semua Data Peribadi yang diminta oleh kami adalah wajib kecuali dinyatakan sebaliknya. Sekiranya anda tidak menyediakan kepada kami maklumat yang berkenaan, kami mungkin tidak dapat menyediakan anda dengan perlindungan insurans atau membalas kepada apa-apa tuntutan.


Pemindahan Data Peribadi

Disebabkan sifat global Kumpulan AXA dan rangkaian perniagaan di seluruh dunia, untuk tujuan yang dinyatakan di atas, kami mungkin memindahkan Data Peribadi di peringkat antarabangsa kepada pihak yang berada di negara lain yang mempunyai rejim perlindungan data yang berbeza. Data Peribadi mungkin dipindahkan ke pusat data AXA AFFIN dan syarikat sekutu kami (“Kumpulan AXA”), pembekal perkhidmatan, rakan kongsi perniagaan, pihak berkuasa kerajaan atau pentadbiran untuk kami memenuhi tujuan yang secara langsung atau tidak langsung sepadan dengan tujuan pegumpulan Data Peribadi.

PenzahiranData Peribadi

Kami mungkin menzahirkan Data Peribadi anda untuk tujuan-tujuan yang dinyatakan di atas kepada pihak-pihak berikut (termasuk di dalam dan di luar Malaysia):

• syarikat-syarikat bersekutu dan syarikat-syarikat berkaitan (“Kumpulan AXA”);

• mana-mana ejen, pembekal perkhidmatan, kontraktor atau pihak ketiga yang menyediakan apa-apa perkhidmatan kepada syarikat-syarikat dalam Kumpulan AXA;

• mana-mana orang yang mempunyai kewajipan kerahsiaan kepada kami; sebagai contoh, juruaudit luar, pengamal perubatan, pemegang amanah, syarikat insurans, dan aktuari;

• agensi kerajaan, badan berkuasa, dan pihak berkuasa lain;

• rakan-rakan perniagaan dan rakan strategik kami;

• Dengan menyambungkan akaun platform digital AXA AFFIN anda dan akaun media sosial anda yang lain, anda membenarkan kami mendedahkan data dengan pembekal akaun media sosial anda yang lain dan anda memahami bahawa penggunaan data yang kami dedahkan akan dikawal selia oleh polisi privasi laman web media sosial penyedia perkhidmatan yang lain. Jika anda tidak mahu Data Peribadi anda didedahkan dengan pengguna lain atau dengan penyedia akaun media sosial anda yang lain, sila jangan pautkan akaun media sosial anda yang lain dengan akaun platform digital AXA AFFIN anda dan jangan ambil bahagian dalam perkongsian sosial di AXA AFFIN platform digital;

• Anda juga boleh mendedahkan Data Peribadi pada papan mesej, laman sembang, halaman profil dan blog, serta platform digital AXA AFFIN lain di mana anda boleh memuat naik data dan kandungan. Kami ingin maklumkan bahawa sebarang maklumat yang anda muat naik atau dedahkan melalui platform ini akan dilihat oleh pelawat, pengguna platform digital AXA AFFIN serta komuniti. Kami menasihati anda supaya berhati-hati apabila cuba mendedahkan Data Peribadi anda, atau sebarang maklumat lain yang berkaitan apabila menggunakan platform digital AXA AFFIN;

• Penerima serah hak atau bakal penerima serah hak, pemeroleh atau bakal pemeroleh dan pengganti hak milik kami;

• Pihak-pihak berkenaan dengan anda telah bersetuju untuk mendedahkan Data Peribadi anda;

• AXA AFFIN mempunyai tanggungjawab untuk melindungi dan mengendalikan Data Peribadi yang digunakan bersama. Akses kepada Data Peribadi dalam AXA AFFIN terhad kepada individu yang mempunyai keperluan untuk mendapatkan maklumat untuk tujuan perniagaan kami.

Permintaan untuk Akses, Pembetulan dan Memadam Data

Kami mengambil semua langkah yang munasabah untuk memastikan bahawa Data Peribadi yang anda berikan, atau pihak anda yang diberi kuasa adalah tepat, lengkap, tidak mengelirukan dan sentiasa dikemas kini selaras dengan tujuan Data Peribadi itu dikumpulkan dan diproses selanjutnya.

Di bawah undang-undang dan peraturan yang berkenaan, anda  mempunyai hak untuk:

• mengakses atau meminda atau membetulkan Data Peribadi anda yang tidak tepat, tidak lengkap, mengelirukan atau tidak terkini;

• meminta pemadaman Data Peribadi anda di bawah alasan tertentu;

• menarik balik kebenaran anda atau meminta perubahan kepada skop persetujuan anda;

• membuat aduan kepada  AXA AFFIN mengenai pengendalian data;

Sila ambil perhatian bahawa sesetengah Data Peribadi mungkin dikecualikan daripada hak akses, pembetulan, bantahan, pemadaman atau penindasan mengikut undang-undang perlindungan data tempatan.

Perlindungan Data Peribadi

Melaksanakan langkah yang mencukupi untuk melindungi Data Peribadi anda adalah keutamaan AXA AFFIN untuk memastikan ia sejajar dengan privasi data dan undang-undang perkhidmatan kewangan yang berkaitan. Namun begitu, tiada penghantaran data melalui internet atau sistem storan data boleh dijamin sepenuhnya. Jika anda mempunyai sebab untuk mempercayai bahawa interaksi anda dengan kami terjejas, sila maklumkan kepada kami dengan segera.

Penyimpanan

Kami tidak akan menyimpan Data Peribadi anda lebih lama daripada yang diperlukan untuk memenuhi tujuan asal ia dikumpul. Kami akan mengambil semua langkah yang munasabah untuk memastikan bahawa Data Peribadi anda dimusnahkan atau dipadamkan secara kekal jika tidak lagi diperlukan melainkan pengekalan sedemikian diperlukan untuk tujuan operasi, audit, undang-undang, kawal selia, cukai atau perakaunan kami.

Perlindungan Data Peribadi

Melaksanakan langkah yang mencukupi untuk melindungi Data Peribadi anda adalah keutamaan AXA AFFIN untuk memastikan ia sejajar dengan privasi data dan undang-undang perkhidmatan kewangan yang berkaitan. Namun begitu, tiada penghantaran data melalui internet atau sistem storan data boleh dijamin sepenuhnya. Jika anda mempunyai sebab untuk mempercayai bahawa interaksi anda dengan kami terjejas, sila maklumkan kepada kami dengan segera.

Data Peribadi individu lain

Apabila memberikan Data Peribadi individu lain kepada kami, anda berjanji:

i)  Untuk memberitahu individu tersebut tentang Polisi ini; dan

ii) Memperoleh sebarang persetujuan undang-undang untuk pengumpulan, penggunaan, pendedahan, dan pemindahan (termasuk pemindahan antarabangsa) Data Peribadi yang berkaitan dengan individu itu menurut Polisi ini.

Maklumat lain yang dikumpul

"Maklumat lain" ialah sebarang maklumat yang tidak mendedahkan identiti individu anda, seperti maklumat laman web dan peranti elektronik, data penggunaan aplikasi, maklumat yang dikumpul melalui cookie, tag piksel dan automasi lain, maklumat demografi dan maklumat lain yang diberikan oleh anda serta maklumat berkaitan.

Kami dan pembekal perkhidmatan kami mungkin mengumpul maklumat tambahan dalam pelbagai cara, termasuk:

• Penggunaan aplikasi data apabila anda memuat turun dan menggunakan aplikasi, seperti tarikh dan masa peranti elektronik anda mengakses server kami dan maklumat serta fail yang telah dimuat turun ke aplikasi berdasarkan nombor peranti anda.

• Cookies adalah fail data yang disimpan terus pada komputer yang anda gunakan dan membolehkan kami mengenal pasti komputer anda dan mengumpul maklumat seperti jenis server internet anda, masa yang dihabiskan menggunakan platform digital AXA AFFIN, halaman yang dilawati, pilihan bahasa dan negara yang berkenaan. Kami mungkin menggunakan maklumat untuk tujuan keselamatan, menambah baik navigasi, memaparkan maklumat dengan lebih berkesan, menyesuaikan pengalaman anda semasa menggunakan platform digital AXA AFFIN, atau mengumpul data statistik tentang penggunaan platform digital AXA AFFIN. Cookies juga membolehkan kami membentangkan pengiklanan atau promosi yang mungkin menarik minat anda. Kami juga mungkin menggunakan Cookies untuk menjejak maklum balas anda kepada iklan kami, dan kami mungkin menggunakan cookies atau fail lain untuk menjejak respons anda terhadap iklan kami.

• Maklumat tertentu seperti lokasi anda atau alat komunikasi pilihan dikumpul apabila anda dengan rela hati berkongsi dengan kami. Melainkan jika digabungkan dengan Data Peribadi, maklumat ini tidak menggambarkan anda secara peribadi.

  Harap maklum bahawa kami boleh menggunakan dan mendedahkan Maklumat Lain untuk sebarang tujuan, kecuali apabila kami dikehendaki berbuat sebaliknya di bawah undang-undang yang berkaitan. Jika kami dikehendaki untuk menganggap Maklumat Lain sebagai Data Peribadi di bawah undang-undang yang berkaitan, maka, sebagai tambahan kepada penggunaan yang disenaraikan dalam “Maklumat Lain Dikumpul" bahagian di atas, kami boleh menggunakan dan mendedahkan Maklumat Lain untuk semua tujuan yang kami gunakan dan mendedahkan Data Peribadi.

Laman Web Pihak Ketiga

Polisi ini tidak berkaitan dan tidak bertanggungjawab ke atas privasi, maklumat atau tindakan lain mana-mana pihak luar yang mungkin memaut ke platform digital AXA AFFIN. Pautan platform digital AXA AFFIN dengan pihak luar lain tidak semestinya menunjukkan kelulusan laman yang dipautkan oleh AXA AFFIN atau Kumpulan AXA.

Harap maklum bahawa AXA AFFIN tidak bertanggungjawab ke atas pengumpulan, penggunaan, pemprosesan dan perkongsian dasar dan tindakan organisasi lain, pembangun aplikasi, penyedia aplikasi, penyedia platform media sosial, pembekal sistem pengendalian, pembekal perkhidmatan wayarles atau pengeluar peranti elektronik yang mengandungi sebarang Data Peribadi yang anda kongsi.

Produk dan Perkhidmatan Baharu

Sebagai sebahagian daripada usaha berterusan kami untuk menggalakkan kesedaran dan pemahaman yang lebih mendalam tentang produk dan perkhidmatan baharu kami untuk manfaat anda, kami dari semasa ke semasa akan menghubungi atau menghantar maklumat kepada anda tentang produk atau perkhidmatan baharu tersebut.

Untuk menarik diri daripada mendapatkan maklumat tentang produk atau perkhidmatan baharu, anda boleh mengklik "unsubscribe" yang terdapat dalam setiap e-mel atau berhubung dengan perkhidmatan pelanggan kami.

Kami berusaha untuk memenuhi permintaan anda untuk menarik diri dari menerima maklumat tentang produk dan perkhidmatan baru dalam jangka masa yang munasabah. Adalah dimaklumkan bahawa jika anda memilih keluar seperti yang dinyatakan di atas, kami tidak akan dapat mengalih keluar Data Peribadi anda daripada pangkalan data pihak luar yang telah kami kongsikan Data Peribadi anda. Dimaklumkan juga bahawa jika anda memilih untuk tidak menerima maklumat pemasaran daripada kami, kami mungkin masih menghantar anda maklumat pentadbiran penting lain yang anda tidak boleh memilih untuk keluar.
